Supreme Court Ruling – Title VII of the Civil Rights Act
June 22, 2020
USPATH hails the June 15, 2020, 6-3 Supreme Court Ruling establishing that Title VII of the Civil Rights Act protects transgender and other LGBQ people from employment discrimination. The opinion, written by Justice Gorsuch, states:
In Title VII, Congress adopted broad language making it illegal for an employer to rely on an employee’s sex when deciding to fire that employee. We do not hesitate to recognize today a necessary consequence of that legislative choice: An employer who fires an individual merely for being gay or transgender defies the law.
At USPATH, we believe this ruling will also mean that transgender and nonbinary people are protected from discrimination within healthcare, as that law is based on the same legal foundation as employment discrimination. Indeed, the ruling constitutes a most welcome relief that will exert a wide impact on society.
The United States Professional Association for Transgender Health wishes to express its sincere gratitude to Justices Gorsuch, Roberts, Bader-Ginzberg, Breyer, Sotomayor, and Kagan along with all those who worked tirelessly to present the logical arguments that supported Monday’s decision.
